       Maryland Court of Appeals held, based on testimony at an
       evidentiary hearing before lower court, that science is unable
       to distinguish reliably between a memory which was forgotten
       and one which was "repressed," and therefore the discovery rule
       does not apply to repressed memory claims.

       California Court of Appeals affirmed that repressed memory
       testimony must meet evidentiary standards in order to be
       admissible, that there was compelling evidence that the
       Kelly-Frye standard was not met, that plaintiffs testimony was
       properly excluded and that the ruling of non-suit was justified
       because plaintiff's testimony was based solely on memories
       generated during the course of guided imagery therapy.

       New Hampshire Supreme Court affirmed Judge Groff's ruling that
       testimony based on recovered memories is not admissible. The
       party offering repressed memory testimony from either an expert
       or complainant has the burden to prove that it is sufficiently
       reliable according to a number of strict factors based on
       Daubert and whether any direct corroboration exists.
       Additional inquiry into the circumstances of memory recovery
       (especially any therapy process) may also be called for.

       the accused person when diagnosing and treating an adult
